1. INDEPENDENT CONTRACTOR RELATIONSHIP

By registering as a Creator Affiliate on the Hustlistan Network, you acknowledge and agree that you are entering into an independent contractor relationship with Hustlistan. This agreement does not create an employer-employee relationship, partnership, joint venture, or agency relationship. You are solely responsible for your own equipment, internet connectivity, tax obligations, and compliance with all applicable laws and regulations in your jurisdiction.

2. COMMISSION STRUCTURE & PAYMENT TERMS

Hustlistan operates exclusively on a Cost Per Action (CPA) performance-based model. Commissions are calculated and accrued only upon successful completion of a qualifying sale transaction.

Commission Validation: All commissions remain in a "Pending" status until the associated order has been successfully delivered to the end customer and payment has been collected. Due to Cash on Delivery (COD) logistics prevalent in Pakistan, this validation cycle typically requires 15-30 business days from order placement.
Return & Refund Policy: In the event of a Return to Origin (RTO), customer-initiated refund, order cancellation, or chargeback, the commission associated with that transaction will be immediately revoked (clawed back) from your account ledger. This policy applies retroactively to all pending and cleared commissions.
Payout Thresholds: Withdrawal requests are processed subject to minimum balance requirements: PKR 1,000 for first-time affiliates and PKR 5,000 for standard affiliates. Processing time is 24-48 hours from request submission.
Payment Methods: Payouts are processed via direct bank transfer (IBAN) or approved digital wallet services. You are responsible for providing accurate banking information. Hustlistan is not liable for delays or failures resulting from incorrect account details.

3. TRAFFIC QUALITY STANDARDS & FRAUD PREVENTION

Hustlistan maintains a zero-tolerance policy regarding fraudulent traffic, artificial inflation of metrics, or any activity that compromises network integrity. Our proprietary traffic monitoring algorithm continuously analyzes traffic patterns and quality metrics to ensure network integrity.

PROHIBITED ACTIVITIES: The following activities constitute material breach of this agreement and will result in immediate account termination and forfeiture of all unpaid earnings:

1. Use of automated scripts, bots, click-farms, or any artificial traffic generation methods.
2. Brand bidding on search engines (PPC campaigns targeting brand-specific keywords) without explicit written authorization from the brand partner.
3. Self-referral transactions (purchasing products through your own affiliate links for the purpose of obtaining discounts or inflating metrics).
4. Misrepresentation of products, services, or promotional offers (including false discount claims or non-existent promotional codes).
5. Use of VPN services, proxy servers, or IP masking tools to circumvent geographic restrictions or quality controls.
6. Manipulation of tracking parameters, cookie stuffing, or any form of attribution fraud.

Our traffic monitoring algorithm requires a minimum quality score greater than 35 to maintain account operational status. Accounts falling below this threshold will be automatically restricted from accessing the dashboard and generating new tracking links until remediation measures are implemented and verified by our compliance team.

4. SQUAD SYSTEM & TIER-2 COMMISSIONS

Eligible affiliates may participate in the Squad System, which provides lifetime override commissions (5-15% of net revenue) on sales generated by affiliates recruited through your referral network. This is a performance-based privilege, not a guaranteed entitlement.

INACTIVITY CLAUSE: To maintain Squad System privileges, the primary affiliate must demonstrate ongoing personal activity. If your personal account generates zero (0) qualifying sales for a period of 30 consecutive calendar days, Hustlistan reserves the right to suspend Squad override commissions until personal sales activity resumes. This clause prevents passive stagnation and ensures network quality standards.

5. INCOME DISCLAIMER & EARNINGS REPRESENTATIONS

Any earnings figures, success stories, or performance metrics displayed on the Hustlistan platform, leaderboard, or marketing materials are illustrative examples of potential earnings and do not constitute guarantees, promises, or warranties of future income. Your actual earnings depend entirely on your individual effort, marketing skills, traffic quality, audience engagement, and market conditions. Hustlistan makes no representations or warranties regarding your potential earnings.

6. LIMITATION OF LIABILITY & INDEMNIFICATION

Hustlistan operates as a technology intermediary platform connecting brand partners with creator affiliates. While we implement rigorous vetting procedures for brand partners, Hustlistan, its officers, directors, employees, and affiliates shall not be liable for:

Inventory shortages, stock-outs, or product unavailability on brand partner stores.
Shipping delays, courier service failures, or logistics disruptions beyond our direct control.
Product quality issues, defects, or customer service disputes between end customers and brand partners.
Brand partner payment defaults or financial insolvency. In such cases, Hustlistan will pursue all available legal remedies to recover funds but is not obligated to compensate affiliates from its own capital reserves.
Technical failures, platform downtime, or data loss resulting from force majeure events, cyberattacks, or third-party service provider failures.
Indirect, incidental, consequential, or punitive damages arising from your use of the platform.

You agree to indemnify, defend, and hold harmless Hustlistan from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your breach of these terms, violation of applicable laws, or any fraudulent or negligent activity on your part.

7. INTELLECTUAL PROPERTY & CONTENT USAGE

All platform content, including but not limited to logos, trademarks, product images, brand assets, and marketing materials, remain the exclusive property of Hustlistan or respective brand partners. You are granted a limited, non-exclusive, revocable license to use approved marketing materials solely for the purpose of promoting authorized campaigns. Unauthorized use, modification, or distribution of platform content is strictly prohibited.

8. TERM & TERMINATION

This agreement remains in effect until terminated by either party. Hustlistan reserves the right to suspend or terminate your account immediately, without prior notice, in the event of material breach, fraudulent activity, or violation of these terms. Upon termination, all pending commissions may be forfeited, and you will be required to return any materials or assets provided by Hustlistan or brand partners.

1. PARTNERSHIP AGREEMENT & RELATIONSHIP

By registering as a Brand Partner on the Hustlistan Network, you enter into a performance-based marketing partnership agreement. This relationship is non-exclusive unless otherwise specified in a separate written agreement. Hustlistan acts as an intermediary technology platform facilitating connections between your brand and independent creator affiliates.

2. COMMISSION PAYMENT OBLIGATIONS

As a Brand Partner, you are contractually obligated to pay agreed-upon commission rates on all qualifying sales attributed to Hustlistan-affiliated traffic sources. Commission rates are established during campaign creation and may vary by product category, campaign type, or negotiated terms.

Invoice Generation: Hustlistan generates automated invoices on a monthly basis (or as specified in your partnership agreement) detailing all approved sales and corresponding commission obligations. Invoices are due within the payment terms specified in your agreement (typically Net-15 or Net-30 days).
Payment Processing: All commission payments must be remitted to Hustlistan's designated account via approved payment methods. Late payments may result in campaign suspension, interest charges, or termination of partnership.
Dispute Resolution: In the event of a sales dispute, both parties agree to work in good faith to resolve the matter. Hustlistan reserves the right to temporarily hold disputed commissions until resolution. Final determination of commission eligibility rests with Hustlistan's compliance team based on available evidence and tracking data.
Return & Refund Impact: Commissions are calculated on net sales (after returns, refunds, and chargebacks). If a sale is returned or refunded, the corresponding commission will be deducted from your next invoice or refunded if already paid.

3. CAMPAIGN COMPLIANCE & RESTRICTIONS

Brand Partners are responsible for ensuring all campaign materials, product information, pricing, and promotional offers comply with applicable laws, regulations, and industry standards. You must accurately represent your products, services, and business practices.

BRAND RESPONSIBILITIES: 1. Maintain accurate product listings, inventory levels, and pricing information on your e-commerce platform.
2. Fulfill orders in a timely manner and provide accurate shipping estimates to customers.
3. Honor all promotional offers, discount codes, and special pricing advertised through Hustlistan-affiliated traffic sources.
4. Comply with consumer protection laws, data privacy regulations, and advertising standards applicable in Pakistan and your target markets.
5. Provide prompt customer service and handle returns/refunds in accordance with your stated policies.

4. TRAFFIC SOURCE RESTRICTIONS & QUALITY CONTROL

Brand Partners may specify traffic source restrictions (e.g., prohibiting paid search ads, social media ads, mobile-only traffic, or desktop-only traffic) through campaign configuration settings. Hustlistan's quality control system monitors compliance with these restrictions and may flag violations for review.

However, Hustlistan cannot guarantee 100% compliance with all restrictions due to the decentralized nature of affiliate marketing. Brand Partners acknowledge that some traffic source misclassification may occur and agree that Hustlistan's quality control measures represent reasonable efforts to enforce restrictions.

5. LIMITATION OF LIABILITY & INDEMNIFICATION

Hustlistan provides technology infrastructure and affiliate network management services. Brand Partners acknowledge and agree that:

Hustlistan is not liable for product quality issues, shipping delays, customer service failures, or any operational issues on the part of the Brand Partner.
Hustlistan is not liable for inventory shortages, stock-outs, or product unavailability that may impact sales conversion rates.
Hustlistan is not responsible for fraudulent transactions, chargebacks, or payment processing issues beyond our direct control.
Hustlistan does not guarantee specific sales volumes, conversion rates, or return on investment (ROI) metrics. Performance depends on multiple factors including product appeal, pricing, market conditions, and affiliate marketing efforts.
Hustlistan's total liability for any claims arising from this agreement shall not exceed the total commission payments made by the Brand Partner in the 12 months preceding the claim.

Brand Partners agree to indemnify, defend, and hold harmless Hustlistan from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from product defects, false advertising, regulatory violations, customer disputes, or any breach of these terms by the Brand Partner.

6. DATA & CONFIDENTIALITY

Brand Partners grant Hustlistan permission to use aggregated, anonymized sales data and performance metrics for network analytics, reporting, and marketing purposes. Individual affiliate identities and specific campaign performance data remain confidential unless disclosure is required by law or with explicit consent.

7. TERM & TERMINATION

This partnership agreement remains in effect until terminated by either party with 30 days written notice, or immediately in the event of material breach. Upon termination, all outstanding commission obligations must be settled, and Brand Partners must remove Hustlistan tracking codes from their websites and marketing materials. Hustlistan reserves the right to terminate partnerships immediately in cases of non-payment, fraudulent activity, or violation of these terms.
